We have now closed our submission form because we cannot confirm the Investigatory Powers Tribunal (IPT) will consider submissions made based on our forms after 5 December 2015.
In its February 2015 decision, the IPT found that the unlawful GCHQ surveillance, on which your claim would be based, became lawful as of 5 December 2014. Once a claim is filed, the IPT will usually only search GCHQ’s records for unlawful activity during the year before the claim was submitted. What this means is that a claim submitted on 14 September 2015 would lead to records being searched for the time period between 14 September 2014 and 5 December 2014. A claim based on the February 2015 decision and submitted on 5 December 2015 or after, therefore, would not encompass any period of unlawful conduct.
